Terms of Service

1. The agreement

These Terms of Service (“Terms”) are a contract between you and Bondi Performance Media Pty Ltd. They apply to every visit to bondiperformancemedia.com and to every page, image, and file we serve from that domain (the “Site”).

If you use the Site on behalf of a company, you confirm you have authority to bind that company, and “you” includes that company.

We may update these Terms. The date at the top is the date this version took effect. The current version is always the one published at bondiperformancemedia.com/terms. If you continue to use the Site after a change, you accept the new Terms. If you do not accept them, stop using the Site.

2. Who operates the site

References to “we”, “us”, and “our” mean Bondi Performance Media Pty Ltd.

3. What this service is

The Site is a curated showcase of free-to-play social games. We publish descriptions, artwork, and links so adults can find browser-based entertainment that uses casino-style mechanics without a cash stake.

The Site may include:

• information about how we choose titles;
• contact details and legal notices;

If another website — including a game we feature — later asks you for a deposit or offers a cash prize, that is not our service. You leave our Site when you follow that link. We are not a party to that transaction and we do not process it.

Anyone who presents this Site as a way to make money is wrong. If you see our name used that way, tell us.

7. Virtual tokens and results

Featured games may show coins, chips, multipliers, free spins, or scores. Those items:

10. Intellectual property

Two kinds of material appear on the Site.

10.1 Our material

10.2 Game names and artwork

Game titles, characters, logos, screenshots, and promotional art belong to their respective owners (studios, publishers, and related companies). We feature them as a catalogue. That is not a claim that we created those games, that we are affiliated with those studios, or that those studios endorse us.

If you are a rights holder and you want artwork or a name removed, write to contact@bondiperformancemedia.com with the URL, the work you object to, and proof of your interest. We will consider the request promptly.

11. Third-party games

When you launch a game you may leave our servers. The game may be hosted by a studio, a platform, or a technology provider we do not control.

Those operators may require their own accounts, cookies, or terms. Their rules apply to play on their service. We do not warrant that a listed game will remain online, remain free, or remain free of in-game purchases on the operator’s side.

If an operator later adds a paid layer, that does not convert our Site into a gambling service. Our catalogue is still a description and a link. You decide whether to continue on their service.

We are not liable for loss, account bans, or content you encounter after you leave the Site.

12. Acceptable use

We may block IP addresses or report abuse to a host or to law enforcement where we reasonably believe these rules have been broken.

14. Communications you send us

18. Australian Consumer Law

If you are a consumer under the Australian Consumer Law, you have rights that these Terms cannot take away. Our goods and services come with guarantees that cannot be excluded. For a major failure, you may reject and receive a refund, or get compensation for any drop in value. You may also be entitled to compensation for reasonably foreseeable loss. If the failure is not major, we may choose to repair, replace, or refund as the law allows.

Nothing in these Terms excludes, restricts, or modifies those rights, except to the extent the law permits.

19. Indemnity

You agree to indemnify Bondi Performance Media Pty Ltd against claims, losses, and reasonable legal costs arising from:

• your use of the Site in breach of these Terms;
• your use of a third-party game after leaving the Site;
• content you send us that infringes someone else’s rights;
• your impersonation of us or misuse of our name.

This indemnity does not apply to the extent a claim is caused by our fraud or by a non-excludable consumer guarantee.

20. Responsible entertainment

Social games can be absorbing. They are still entertainment, not a way to make money.

• Play only if you are 18 or older.
• Stop if the session stops being fun.
• Do not chase a feeling from a social title by opening a real-money account.

22. Links

Links to studios, help services, or regulators are provided for convenience. They are not an endorsement. We are not responsible for their content or their availability.

23. Suspension and termination

We may refuse or suspend access to the Site, in whole or in part, at any time, including if we believe you have broken these Terms or if we take the Site offline. You may stop using the Site at any time. Sections that by their nature should survive (including intellectual property, disclaimers, liability, indemnity, and governing law) survive termination.

24. Severability and waiver

If a court finds a part of these Terms unenforceable, the rest still applies. If we do not enforce a right on one occasion, that is not a waiver of that right later.

25. Entire agreement

These Terms and the Privacy Policy are the entire agreement between you and us about the Site. They replace any earlier statements about the Site, whether on older pages or in correspondence, unless we sign a separate written agreement that says otherwise.

26. Governing law

These Terms are governed by the laws of New South Wales, Australia, and the Commonwealth of Australia as it applies in NSW. You and we submit to the exclusive jurisdiction of the courts of New South Wales, and courts that hear appeals from them, except that we may still seek urgent injunctive relief in any forum to protect intellectual property or to stop impersonation.
